By accessing and using the cliff-trek website and services, you accept and agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use our website or services.

These terms apply to all visitors, users, and others who access or use our services. We reserve the right to modify these terms at any time, and such modifications will be effective immediately upon posting.

2. Service Description

cliff-trek provides premium vehicle rental services in Perth, Western Australia. Our website allows users to browse our fleet, request reservations, and access information about our services. All rental agreements are subject to separate terms and conditions provided at the time of booking.

3. Eligibility Requirements

To rent a vehicle from cliff-trek, you must:

  • Be at least 25 years of age (drivers aged 21-24 may be eligible with additional restrictions and fees)
  • Hold a valid, unrestricted driver's licence appropriate for the vehicle class
  • Provide a valid credit card in your name for the security deposit
  • Meet our insurance and credit requirements
  • Not have had your licence suspended or revoked in the past 5 years

4. Reservations and Bookings

Reservation requests submitted through our website are subject to availability confirmation. A reservation is not confirmed until you receive written confirmation from cliff-trek. We reserve the right to decline any reservation request at our discretion.

All quoted prices are subject to change until a reservation is confirmed. Prices include GST where applicable. Additional charges may apply for optional extras, excess kilometres, fuel, tolls, and cleaning.

5. Cancellation Policy

Cancellations made more than 48 hours before the scheduled pickup time will receive a full refund. Cancellations within 48 hours may incur a cancellation fee equivalent to one day's rental. No-shows or cancellations at pickup time forfeit the full deposit.

6. Vehicle Use

Rented vehicles must be used in accordance with all applicable laws and our rental agreement. Prohibited uses include but are not limited to:

  • Use by unauthorised drivers
  • Transportation of goods for hire
  • Racing, speed testing, or driver training
  • Driving on unsealed roads without prior approval
  • Use while under the influence of alcohol or drugs
  • Transportation of hazardous materials
  • Use outside Western Australia without prior approval

7. Insurance and Liability

All rentals include comprehensive insurance with a standard excess. You are responsible for the excess amount in the event of damage or theft. Excess reduction options are available at additional cost. Insurance does not cover damage resulting from prohibited use or driver negligence.

8. Intellectual Property

All content on this website, including text, graphics, logos, images, and software, is the property of cliff-trek or its content suppliers and is protected by Australian and international copyright laws. You may not reproduce, distribute, modify, or create derivative works without our express written consent.

9. User Conduct

When using our website, you agree not to:

  • Violate any applicable laws or regulations
  • Submit false or misleading information
  • Interfere with the proper functioning of the website
  • Attempt to gain unauthorised access to our systems
  • Use automated systems to access the website without permission
  • Transmit viruses or other harmful code

10. Disclaimer of Warranties

This website and its content are provided "as is" without warranties of any kind, either express or implied. We do not warrant that the website will be uninterrupted, error-free, or free of viruses or other harmful components.

These terms shall be governed by and construed in accordance with the laws of Western Australia. Any disputes arising from these terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Western Australia.
